District Attorney Hoovler Announces 11 Year Prison Sentence in Newburgh Robbery Case

Tyreek Shelby Previously Pled Guilty to Robbery in the First Degree

 Orange County District Attorney David M. Hoovler announced that Tyreek Shelby, 19, of Newburgh, was sentenced in Orange County Court to eleven (11) years in prison to be followed by five (5) years of post-release supervision relative to his previous guilty plea to Robbery in the First Degree.  Shelby’s co-defendant, Nasier Codett, previously pled guilty to Robbery in the First Degree and is awaiting sentence.

As alleged in documents filed and statements made in court, on July 1, 2023, Shelby and Codett turned off the power to a gas station in the City of Newburgh and then held up the clerk at gunpoint using a rifle and stole money from the register as well as lotto tickets and cigarettes.  The clerk was ordered to open the ATM and when he was unable, one of the men discharged the gun into the ground and hit the clerk in the head.  A witness to the robbery called the police, who responded to see the clerk with his hands up.  The police chased the suspects who barricaded themselves in a backroom of the gas station and were later taken into custody.  At the plea proceedings, Shelby admitted to forcibly stealing money and/or merchandise from the gas station and in the course of the crime he or another participant in the crime used or threatened to use a gun.

District Attorney Hoovler thanked the City of Newburgh Police Department for their investigation and the arrest of the defendant.  District Attorney Hoovler also thanked the Orange County Sheriff’s Office, Town of Newburgh Police Department and New York State Police for their assistance in the investigation and in apprehending the defendant.

“The wildly dangerous actions of these defendants demand just consequences,” said District Attorney David M. Hoovler. “Thankfully, the significant prison sentence imposed on this offender stands as a warning to those violent criminals who might consider engaging in similar conduct.  We will not stand by while violent crime is perpetrated in our communities.  I thank the law enforcement agencies for their work in helping to bring these criminals to justice.”

The case is being prosecuted by Senior Assistant District Attorney Christopher Kelly.

This criminal charge is merely an allegation that a defendant has committed a violation of the criminal law, and it is not evidence of guilt. All defendants are presumed innocent and entitled to a fair trial, during which it will be the State of New York’s burden to prove guilt beyond a reasonable doubt.
