Rudolph Davis Convicted of Criminal Possession of a Weapon in the Second Degree
Orange County District Attorney David M. Hoovler announced that Rudolph Davis, age 31, of Newburgh, was sentenced in Orange County Court to thirteen (13) years in prison to be followed by five (5) years of post-release supervision after having been convicted in July of Criminal Possession of a Weapon in the Second Degree, the sole charge against him, after a jury trial.
As alleged at trial, on November 5, 2023 at approximately 1:05 a.m., members of the Town of Montgomery Police Department responded to a complaint for an individual menacing others with a gun in the Village of Maybrook. The responding officers located a van matching the description in the complaint driving away from the location. When the police stopped the vehicle, they found it to be operated by a woman, who was separately charged, while Davis was the front seat passenger. A search of the vehicle resulted in the recovery of a loaded 9mm handgun in the center console. Davis was found to have additional rounds matching the gun in his pocket, which also matched rounds located at the scene of the original incident.
District Attorney Hoovler thanked the Town of Montgomery Police Department for their investigation which led to the arrest of Davis. District Attorney Hoovler also thanked the Orange County Sheriff’s Office and the New York State Police who assisted in the investigation.
“Dangerous criminals who illegally possess and use dangerous firearms must be held accountable,” said District Attorney David M. Hoovler. “All too frequently we see wanton violence committed with the use of illegally possessed guns. My Office, together with our law enforcement partners, remain steadfast in our commitment to the pursuit of illegally possessed firearms and the offenders who wield them. Our community demands and deserves nothing less than this unwavering commitment.”
The case is being prosecuted by Senior Assistant District Attorney Christopher Kelly and Assistant District Attorney Anthony Molina.
This criminal charge is merely an allegation that a defendant has committed a violation of the criminal law, and it is not evidence of guilt. All defendants are presumed innocent and entitled to a fair trial, during which it will be the State of New York’s burden to prove guilt beyond a reasonable doubt.
