Carroll Dolshun Pled Guilty to Attempted Criminal Sale of a Controlled Substance in the Third Degree
Both Defendants Expected to be Sentenced to Prison Terms
Orange County District Attorney David M. Hoovler announced that on Monday, September 9, 2024, Taino Lopez, 26, of Port Jervis, pled guilty in Orange County Court to Criminal Sale of a Controlled Substance in the Third Degree. Under the plea agreement announced on the record at the time that Lopez pled guilty, it is expected that he will be sentenced to five (5) years in prison to be followed by three (3) years of post-release supervision when he is in court next on November 4, 2024.
District Attorney Hoovler further announced that on Monday, September 9, 2024, Carroll Dolshun, 38, of Port Jervis, pled guilty in Orange County Court to Attempted Criminal Sale of a Controlled Substance in the Third Degree. Under the plea agreement announced on the record at the time that Dolshun pled guilty, the People will recommend he be sentenced to four (4) years in prison to be followed by a period of post-release supervision when he is in court next on October 29, 2024.
As alleged in documents filed and statements made in court, on February 9, 2024 an undercover officer with the City of Middletown Police Department met with Lopez and negotiated to purchase a quantity of crack-cocaine. After the undercover officer gave Lopez money, he gave the officer the agreed upon drugs, which were subsequently analyzed at the crime laboratory which confirmed the presence of cocaine. At the plea proceedings Lopez admitted to knowingly and unlawfully selling the narcotics.
As alleged in documents filed and statements made in court, on two dates in late 2022 and early 2023, Dolshun sold quantities of cocaine to another individual at his residence in the City of Port Jervis. As a result, members of the City of Port Jervis Police Department sought a judicially-authorized search warrant for the residence. During the execution of the warrant, law enforcement recovered narcotics, digital scales, and packaging materials used to prepare narcotics for sale. At the plea proceedings Dolshun admitted to attempting to sell possessing the cocaine to another individual.
District Attorney Hoovler thanked the City of Middletown Police for their investigation and the arrest of Lopez and the City of Port Jervis Police for their investigation and the arrest of Dolshun.
“Drug dealers peddle death, and it requires the proactive efforts of the police to root out their crimes,” said District Attorney David. M. Hoovler. “Together with our law enforcement partners we are committed to interrupting the flow of drugs into our communities and to identifying, arresting and, where appropriate, incarcerating those responsible. My Office will continue to lead by example and dedicate the necessary resources to hold drug dealers accountable for their crimes.”
The Lopez case is being prosecuted by Assistant District Attorney Alexis Gregory and the Dolshun case is being prosecuted by Assistant District Attorney Bryan Conway.
This criminal charge is merely an allegation that a defendant has committed a violation of the criminal law, and it is not evidence of guilt. All defendants are presumed innocent and entitled to a fair trial, during which it will be the State of New York’s burden to prove guilt beyond a reasonable doubt.
