James Pospisil Sentenced to 15 Years in Prison
Orange County District Attorney David M. Hoovler announced that James Pospisil, age 45, of Port Jervis, was sentenced in Orange County Court to fifteen (15) years in prison to be followed by fifteen (15) years of post-release supervision relative to his previous plea of guilty to Attempted Rape in the First Degree. As part of the sentence, Pospisil will also be registered as a sex offender under the New York Sex Offender Registration Act (SORA). At the plea proceedings, Pospisil admitted that between December 22, 2023 and January 2, 2024 he did attempt to engage in sexual intercourse with an individual who was less than eleven (11) years old.
District Attorney Hoovler thanked the Orange County Child Abuse Investigation Unit for their investigation which led to the arrest of the defendant.
“The significant sentence imposed on this offender for his unspeakable actions will help to ensure he cannot harm another child,” said District Attorney David M. Hoovler. “I commend the bravery of the survivor and hope the sentence will offer a degree of closure. My Office, together with our law enforcement partners, will bring to bear all resources available to us in our pursuit of sexual predators. We will continue to provide support for victims of sexual assault and seek to hold offenders accountable for their actions.”
The case is being prosecuted by Assistant District Attorney Nicholas Mangold.
A criminal charge is merely an allegation by the police that a defendant has committed a violation of the criminal law, and it is not evidence of guilt. All defendants are presumed innocent and entitled to a fair trial, during which it will be the State of New York’s burden to prove guilt beyond a reasonable doubt.
