Rudolph Davis Convicted of Criminal Possession of a Weapon in the Second Degree
Defendant Faces up to 15 Years in Prison
Represents 40th Felony Gun Possession Conviction in Orange County in the Last Year
Orange County District Attorney David M. Hoovler announced that on Friday, July 12, 2024, Rudolph Davis, age 31, of Newburgh, was convicted after a jury trial in the Orange County Court of Criminal Possession of a Weapon in the Second Degree, the sole charge against him. Davis faces up to fifteen (15) years in prison when he is scheduled to be sentenced on October 17, 2024. Davis was remanded back to the Orange County Jail without bail following the jury’s verdict.
As alleged at trial, on November 5, 2023 at approximately 1:05 a.m., members of the Town of Montgomery Police Department responded to a complaint for an individual menacing others with a gun in the Village of Maybrook. The responding officers located a van matching the description in the complaint driving away from the location. When the police stopped the vehicle, they found it to be operated by a woman, who was separately charged, while Davis was the front seat passenger. A search of the vehicle resulted in the recovery of a loaded 9mm handgun in the center console. Davis was found to have additional rounds matching the gun in his pocket, which also matched rounds located at the scene of the original incident.
District Attorney Hoovler thanked the Town of Montgomery Police Department for their investigation which led to the arrest of Davis. District Attorney Hoovler also thanked the Orange County Sheriff’s Office and the New York State Police who assisted in the investigation.
“Lethal weapons in the hands of dangerous criminals are a recipe for disaster,” said District Attorney David M. Hoovler. “As the 40th conviction for felony gun possession in Orange County in the past year represents, our message is clear: we will not cease our pursuit of the illegal possession and use of firearms. Our community demands and deserves nothing less than this steadfast commitment. I applaud the often dangerous work of law enforcement to investigate and arrest perpetrators such as the one convicted today.”
District Attorney Hoovler highly commended Senior Assistant District Attorney Christopher Kelly and Assistant District Attorney Anthony Molina who prosecuted the case.
This criminal charge is merely an allegation that a defendant has committed a violation of the criminal law, and it is not evidence of guilt. All defendants are presumed innocent and entitled to a fair trial, during which it will be the State of New York’s burden to prove guilt beyond a reasonable doubt.
